BluePony Technologies, Inc. ("we," "us," "our," or "Company") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you sign up for, access, or use our API (the "API" or "Services").

By using the Services, you agree to the collection and use of information in accordance with this Policy. If you do not agree, please do not use the Services.

We may update this Policy from time to time. We will notify you of material changes by posting the updated Policy on our website or via email, and your continued use of the Services constitutes acceptance.

1. Information We Collect

We collect information in the following ways:

a. Information You Provide Directly:

  • When you create an account or sign up: Name, email address, company name, and billing/payment information (if applicable).
  • API keys or authentication credentials.
  • Any information you submit via support requests, emails, or feedback.

b. Information Collected Automatically:

  • Usage Data: API request details (e.g., endpoints accessed, timestamps, query parameters like airport codes or locations for weather data), IP address, browser/device type, and error logs. This helps us monitor performance, detect abuse, and improve the Services.
  • Location Data: We may infer approximate location from IP address or process location-based queries (e.g., airport identifiers) you submit to provide relevant weather data. We do not collect precise GPS location unless explicitly provided in queries.
  • Cookies and Similar Technologies: If you access our website or developer portal, we use cookies for session management, analytics, and security. You can manage cookies via your browser settings.

c. Information from Third Parties:

  • Payment processors (e.g., Stripe) for billing.
  • Analytics providers (e.g., Google Analytics) for aggregated usage insights.

We do not collect sensitive personal information (e.g., health data, racial/ethnic origin) unless voluntarily provided (which we discourage).

2. How We Use Your Information

We use collected information to:

  • Provide, maintain, and improve the Services (e.g., deliver accurate weather data based on your queries).
  • Process payments and manage accounts.
  • Communicate with you (e.g., support, updates, service announcements).
  • Detect and prevent fraud, abuse, or security issues (e.g., rate limiting API usage).
  • Analyze usage trends (in aggregated, anonymized form) to enhance features.
  • Comply with legal obligations.

We process location-related queries solely to fulfill weather requests and do not use them for tracking or profiling.

3.Sharing Your Information

We do not sell your personal information.

We may share information with:

  • Service Providers: Third-party vendors for hosting, payment processing, analytics, email delivery, and support (e.g., AWS for cloud hosting). They are contractually obligated to protect your data.
  • Legal Requirements: If required by law,court order, or government request.
  • Business Transfers: In connection with a merger, acquisition, or sale of assets.
  • Aggregated/Anonymized Data: Non-personal, aggregated data for industry reports or improvements (no individual identification).

Weather data provided via the API is sourced from third parties (e.g., NOAA); their privacy practices apply to that content.

4. Data Security

We implement reasonable technical and organizational measures to protect your information, including encryption, access controls, and secure servers. However, no system is completely secure, and we cannot guarantee absolute security.

5. Data Retention

We retain personal information only as long as necessary for the purposes described (e.g., active accounts) or required by law.

Usage logs are retained for a limited period (e.g., 12-24 months) for security and analytics. You can request deletion of your account/data (see below).

6. Your Rights and Choices

Depending on your location, you may have rights to:

  • Access, correct, or delete your personal information.
  • Opt out of certain processing (e.g., marketing emails).
  • Request data portability.
  • Withdraw consent (where applicable).

California residents: We do not "sell" data as defined under CCPA.

EU/UK residents: Our processing is based on contract necessity, legitimate interests, or consent. You can lodge complaints with a supervisory authority.

You can manage cookies, unsubscribe from emails, or delete your account via your dashboard.

7. Children's Privacy

The Services are not intended for children under 16 (or applicable age in your jurisdiction). We do not knowingly collect data from children.

8. International Data Transfers

Your information may be processed in the United States or other countries. We use safeguards (e.g., Standard Contractual Clauses) for international transfers.
